Due Diligence


Environmental due diligence is necessary for every development and redevelopment project. The formal process of environmental due diligence assesses the proposed development property for potential risk of environmental contamination, such as groundwater or soil contamination. Standards for conducting environmental diligence are set forth by the Environmental Protection Agency (EPA). Environmental due diligence professionals determine, based on the property, the extent and type of assessment warranted.

Environmental assessments can protect clients from potentially crippling environmental liabilities under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA). Even if there is contamination found after the purchase is made, protection under the CERCLA may assist owners, innocent landowners, and bona fide prospective purchasers. In order for one of these parties to qualify, All Appropriate Inquiries (AAI) must be conducted prior to property aquisition. This means conducting environmental due diligence at the beginning, through a Phase I Environmental Site Assessment (ESA). Our services include:
